Terms of service

These terms cover your use of the Bloody Good Builders marketplace, run by Bloody Good Builders (ABN 25 683 517 606, "we", "us"). By submitting a project or using a builder account, you're agreeing to them. Plain English throughout - that's a feature, not an accident.
What we are (and aren't)
We're an introduction service. We review project requests, vet builders, and connect the two. We are not a builder, we're not a party to any contract between you and a builder, and we don't guarantee that any builder will take on your project or that you'll win any work. Builders in our network are independent businesses responsible for their own work, licensing, insurance, quotes, and contracts.
For clients
Submitting a project costs a one-off fee of $25 including GST (free while we're pre-launch; we'll say so clearly on the form when the fee is live). What it buys: human review of your request and, if approved, introduction to up to three vetted builders suited to your project. Our refund promise: if we reject your request at review, you get the full amount back automatically. If no builder takes up your lead within 14 days of publication, you get the full amount back automatically. If you reckon we've fallen short beyond that, email billing@bloodygoodbuilders.com.au - if we haven't delivered you value, we don't keep your money. Nothing in these terms limits your rights under the Australian Consumer Law.
For builders
Membership is curated: we vet applications, including checks of every licence or registration listed against the issuing regulator, business-number checks, and insurance, and we can decline or remove members to keep the network quality high. Standard membership is $150 per month including GST, with your first 30 days free (including access to 5 leads during the trial). Founding members pay less - see below. After the trial, fair use applies to lead access - currently 15 leads per month. Cancel any time; access runs to the end of the paid period. You agree that the information in your application and profile is accurate, that you hold the licences and insurance required for the work you take on, and that you'll treat clients decently - no spam, no pressure tactics. Client contact details revealed to you are for quoting that project, not for marketing lists.
Founding members
While we're building the network in a new area, the first members in get a reduced founding rate. If you're offered one, the rate is set out in your invitation and shown on your account. There's no minimum term, no contract, and no end date on it - it's simply what you pay, for as long as you stay a member, and it doesn't go up when standard pricing does. Cancel whenever you like; access runs to the end of the month you've paid for. Everything else is the same as any other membership: same vetting, same lead access, same fair-use cap.
The one catch, and we'd rather say it plainly than have you find out later: the founding rate goes with the membership, not with you. If you cancel, that's the end of it - come back later and you'll pay whatever membership costs at the time. It's a thanks for backing us early, not a discount code you keep in your wallet.
A failed payment isn't cancelling. If a card expires or a payment bounces we'll chase you for 30 days, and your founding rate is safe the whole time - sort it out within that window and nothing changes.
Conduct, and when we'll show someone the door
Membership means something or it means nothing. If you don't hold the licences or insurance you told us about, misrepresent yourself to a client or another member, don't turn up, don't pay a subcontractor you engaged through the tender board, or treat people badly, we can suspend or cancel your membership. We'll tell you why, and you can put your side of it.
To be clear about what that is and isn't: it's a decision about who stays in the network, not a remedy for whoever's out of pocket. We're not a party to the work you agree with a client or another member, we don't take a cut of it, and we don't arbitrate it - see the next bit.
The tender board
Members can put subcontract packages out to the network and bid on each other's. Bids are sealed - the member who posted sees every bid, and nobody else sees anyone's but their own. When a tender is awarded we swap contact details between the two of you and step back.
The contract is between the two of you. We're not a party to it, we don't take a cut, we don't hold any money, and we don't arbitrate disputes about price, scope, variations, delays, defects or payment. If it goes wrong, that's between you and them, and the usual avenues - a lawyer, QBCC or your state's equivalent, or the tribunal - are the ones that apply. What we will do is act on conduct that reflects on the network, as above.
Our records
We keep a record of the decisions we make - approving or declining a project request or a builder application, refunds we issue, and which leads were shown to and taken up by which builders. We keep them so we can be held to account for decisions that move money and answer you if you ask why one went the way it did. The privacy policy covers what's in them.
Leads
A lead is shared with at most three builders. We score and present leads using honest, transparent factors, but scores are guidance, not a promise about a project's value or outcome.
The boring-but-necessary bits
Content on this site (aside from what you submit) is ours; don't scrape or republish it. To the extent the law allows, we're not liable for indirect or consequential loss arising from the service, and our total liability is capped at the amount you've paid us in the past 12 months - but nothing here excludes guarantees, rights, or remedies that can't be excluded under the Australian Consumer Law. We can update these terms; material changes get flagged by email and continued use means acceptance. These terms are governed by the laws of Queensland, Australia.
